BY ENTERING, BROWSING, SUBMITTING YOUR ORDER FOR PROCESSING OR IN ANY OTHER WAY OF USING THIS WEBSITE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AGREED AND ACCEPTED ALL THE TERMS AND CONDITIONS IN THE FORM THEY APPEAR AT THE TIME YOUR ORDER IS SUBMITTED FOR PROCESSING. SO, PLEASE READ CAREFULLY BEFORE PROCEEDING.
You confirm and guarantee that you are at least 18 years old, the legal drinking age in the Philippines. You also guarantee that the information provided by you (including payment details) is actual, correct and complete. We will not share this information with anyone for getting any financial benefit but only for fulfilling our obligation to you. By submitting your order for processing, you confirm that you are the person referred to in the Billing details.
The User is responsible for maintaining the confidentiality of all personal details relating to the website (including the User's account and/or password). The User agrees to take responsibility for all activities that are performed under the User's account and/or password. Only the User will be responsible for access to the website and use of the website by anyone using the User's identification and password including absolutely all actions and obligations appeared during such access or/and use of the website. The User agrees to notify The Scotch Malt Whisky Society immediately regarding any unauthorized use of the User's account or any other violation of security. We keep the right to refuse service, cancel accounts or/and orders, if we think that User's actions can be harmful to us.
Visitors under the age of 18 must not submit any information and must not register with the website.
These Terms and Conditions constitute the entire agreement between the customer and The Scotch Malt Whisky Society and govern the customer's use of the website, superseding any prior agreements between the user and The Scotch Malt Whisky Society with respect to the website.
The Scotch Malt Whisky Society will not be responsible for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our control.
No agent or representative of The Scotch Malt Whisky Society is authorized to make any warranties, representations or statements regarding the products and The Scotch Malt Whisky Society shall not in any way be bound by any such unauthorized warranties, representations or statements.
The Scotch Malt Whisky Society reserves the right to change or remove (temporarily or permanently) the website or any part of it without notice and Customer confirms that The Scotch Malt Whisky Society shall not be liable to Customer for any such change or removal.
The Scotch Malt Whisky Society reserves the right to change these Terms and Conditions at any time, and Customer's continued use of the website following any changes shall be deemed to be Customer's acceptance of such change.
All of our single cask whiskies are limited by nature, and therefore only available in small quantities. All products are available while stocks last.
Availability is subject to change at any time without notice.
Everything is done to ensure that the photographic representation, description and specification of each product is correct. However, errors regarding product information, tasting notes, pack photo shoots or typographical errors on the website may occur.
All prices shown on the website are in Philippines pesos.

Prices are subject to change at any time without notice.
After payment, you will receive via email a confirmation of your order. Should you need to retrieve your invoice, you will be able to view it by logging in at The Scotch Malt Whisky Society Philippines website, ‘www.smws.ph’ and select “view your orders/invoices”.
We will accept the return of products, and replace them (if in stock) or issue a full refund, when:
- the products have demonstrably been damaged prior to transit or
- the products received are clearly different from those ordered or
- the products for which the customer has been charged have not been delivered
And the recipient has notified us of the fact within 24 hours of receipt.
Products shall not be returned unless and until the customer or recipient has

- The Scotch Malt Whisky Society has accepted the return of the goods.
The Scotch Malt Whisky Society shall be responsible for the cost of transit by the method specified by us.
Refunds will be credited back to your account upon our receipt of the products. The duration that the bank or Paypal will take to process the refund request cannot be guaranteed by us. You should contact the bank that issued your card or Paypal for more details.
The User hereby expressly states to understand and agree that use of website is at User's sole risk. Neither The Scotch Malt Whisky Society, nor its officers, directors, agents, subsidiaries, joint ventures, holding companies, affiliates, employees, third-party content providers, or the like, warrant that the website will be uninterrupted or error-free. They also do not provide any warranty as to the results that may be obtained from direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or any other intangible losses obtained from the use of the website, or as to the accuracy, reliability, or currency of any information content, service, or merchandise provided through the website.

Other than as required under applicable law, under no circumstances will The Scotch Malt Whisky Society be liable for any loss or damage caused by the User's reliance on information obtained through the website or linked sites, or User's reliance on any product or service obtained from a linked site. The user is hereby expressly requested to seek the advice of professionals, as appropriate, regarding the evaluation of any specific opinion, advice, product, service, or other content.
The website is operated in the Philippines. These Terms and Conditions shall be governed by and construed in accordance with the law of the Philippines and you hereby submit to the exclusive jurisdiction of the Philippines court. If any of these Terms and Conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
We are registered under the Data Protection Act 1998 and as such, any information concerning the Customer and its respective records may be passed to third parties. However, the Customer’s records are regarded as confidential and therefore will not be divulged to any third party, except if legally required to do so by the appropriate authorities. The Customer has the right to request sight of, and copies of any and all customer's records we keep, on the proviso that we are given reasonable notice of such a request. The Customer is requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue the Customer with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.
We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited e-mails.
Any emails sent by The Scotch Malt Whisky Society will only be in connection with the provision of agreed services and products.

Conditions of Membership
Membership Card- Membership is available to qualifying individuals aged 18 years and over in the Philippines or of legal drinking age in their country of residence.
- The membership card can only be used by the individual to whom the card has been issued.
- The Scotch Malt Whisky Society Ltd reserves the right to refuse membership to any applicant. Membership is revocable by The Scotch Malt Whisky Society without cause and without refund for any remaining period of the subscription.
- Your membership card must be shown on entering Members’ Venues.
- Membership is subject to any and all rules adopted by The Scotch Malt Whisky Society, and these rules may be amended from time to time without notice.
Lost or stolen cards should be reported as soon as possible to the Philippines Sales Team at info@smws.ph. Replacement cards will be issued on request and at our discretion. Repeated requests for replacement cards will be charged for at XXX per card. Replacement cards can only be issued in the name of the original member.
Memberships can be renewed annually at the rates below, which are applicable to all renewals made within the first 5 weeks following the expiration of the membership.

1. Renewal is for a 12-month period based on the month of initial enrolment, whether or not shopping privileges have been exercised.
